Zero liability regarding document contents, legality of signatures for specific use-cases, and platform availability.

1. Zero Liability for Document Contents

ViViD eSigner functions purely as a technological conduit for executing electronic signatures. ViViD App Studio assumes absolutely no liability or responsibility for the actual contents, clauses, legality, or enforceability of the documents uploaded and signed using our platform.

We do not review, endorse, or validate the agreements made between signing parties. Any legal obligations arising from the signed documents are strictly between the parties involved.

2. Exceptions under IT Act 2000

Users must be aware that under the Information Technology Act, 2000 (India), electronic signatures are NOT legally recognized for certain documents, including but not limited to:

  • Negotiable Instruments (e.g., Promissory Notes, Cheques)
  • Powers of Attorney (PoA)
  • Trust Deeds
  • Wills and Testamentary Dispositions
  • Real Estate Contracts (Title Transfers, Leases beyond a specific tenure)

It is the user's sole responsibility to ensure that the document they are signing electronically is legally permissible to be executed in this manner under Indian Law.

3. "As Is" Warranty & Platform Availability

The ViViD eSigner platform is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for 99.9% uptime, ViViD App Studio does not guarantee uninterrupted, secure, or error-free operation of the services.

We are not liable for any direct, indirect, incidental, or consequential damages resulting from technical outages, data loss, or third-party API failures (such as UIDAI Aadhaar eSign downtimes).
